1. Introduction

Welcome to Last Lap Trivia.

These Terms and Conditions ("Terms") are an agreement between you and Morgan Rand ("we," "us," "our"), an individual based in Florida, United States, who operates Last Lap Trivia, a daily motorsport geography trivia game available at lastlaptrivia.com (the "Site"). The Site and everything we provide through it, including the game, accounts, leaderboards and paid subscriptions, are the "Service."

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. By accessing or using the Site, creating an account, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

Last Lap Trivia is a daily game in which you answer motorsport trivia questions by placing pins on a map. You can play without signing in, but signing in allows you to save your scores and streaks across devices.

We offer two ways to use the Service:

Free version. Free to play, and supported by ads.

Pro version. An optional paid subscription, described in Section 7.

We do not guarantee that the Service will always be available, accurate or free from errors or interruptions.

3. Eligibility and age

You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority or digital consent where you live, you may use the Service only with the permission of a parent or guardian. A subscription may be purchased only by an adult, or by a parent or guardian on a minor's behalf.

By using the Service, you confirm that you meet these requirements and that you have the legal capacity to agree to these Terms. If you are a parent or guardian giving permission, you agree to these Terms on behalf of the minor.

The Service is operated from the United States. If you use it from another country, you are responsible for following the laws that apply to you.

4. Accounts

You can sign in with your Google account. Sign-in is processed by Google, and account services are provided by Supabase, as described in our Privacy Policy. When you sign in, you agree to:

Keep your account secure and be responsible for activity under it

Tell us promptly at support@lastlaptrivia.com if you believe your account has been accessed without permission

You choose a game display name that is separate from your Google profile name. You may not use a display name that:

• Is the name of another person or entity you have no right to use
• Is offensive, vulgar, obscene, hateful or harassing
• Infringes someone else's trademark or other rights
• Contains personal information such as an email address or phone number

We may refuse service, change or remove a display name, or suspend or terminate an account if we reasonably believe these Terms have been violated.

5. Public information

Your display name, saved scores, lap distances and streaks are publicly readable, as explained in our Privacy Policy. Choose a display name you are comfortable making public.

By choosing a display name and playing while signed in, you grant us a non-exclusive, worldwide, royalty-free license to display your display name and game results on the Site and in public leaderboards, including a leaderboard we may add in the future.

6. Free version, ads and sponsorships

The free version of the Site shows ads, which we provide through Google AdSense. Ads are supplied by third parties. We do not control their content, and we do not endorse the products or services they promote. Any dealings you have with an advertiser are between you and the advertiser. How ads and related cookies work is explained in our Privacy Policy.

Sponsorships. We may display sponsored content on the Site, such as a sponsor’s name, logo or link. For example, we may label a daily puzzle as “Today’s Stint is sponsored by [sponsor].” Sponsorships are paid for by the sponsor and will be clearly labeled as sponsored. We do not control sponsors’ products, services or claims, and a sponsorship does not mean we endorse the sponsor or anything it offers. A sponsor’s names and marks belong to the sponsor. If you click a sponsor’s link, you leave the Site, and the sponsor’s own terms and privacy policy apply.

7. Paid subscriptions

Last Lap Pro is a paid subscription plan, billed monthly or annually through Stripe. Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings.

7.1 What a paid subscription includes

While you are signed in with an active paid subscription, Last Lap Pro includes:

• No ads during gameplay. We do not show you third-party advertising from our ad network. Sponsorship notices, such as “Today’s Stint is sponsored by...,” may still appear for all users, including Pro subscribers. See Section 6.
• Access to all previous days’ trivia questions.
• Category options. The ability to play only questions from the racing category you choose, from the options that are available. The free version instead gives you five daily questions drawn from a mix of all categories.

7.2 Billing and renewal

Subscriptions are billed in advance on a recurring basis, monthly or annually, depending on the plan you choose. Your subscription renews automatically at the end of each billing period for the same length of time, at the then-current price, until you cancel it. Prices may exclude applicable taxes, which will be shown at checkout where required.

7.3 Payment

Payments are processed by Stripe. We do not store or collect your full card number. By starting a subscription, you authorize us, through Stripe, to charge your payment method for the subscription fee and any applicable taxes on each billing date. You confirm that you have the legal right to use the payment method, and that the information you provide is true, correct and complete.

If a payment fails, we or Stripe may try again. If we cannot collect payment, we may pause your Pro access or cancel your subscription.

7.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You keep Pro access until then, and you will not be charged again.

7.5 Price changes

We may change subscription prices at any time. A price change takes effect at the start of your next billing period, and we will give you reasonable advance notice, such as by email or a notice on the Site, so you can cancel before it applies. If you keep your subscription after the change takes effect, you agree to the new price.

7.6 Refunds

All subscription fees are non-refundable except as required by law.

7.7 Our right to refuse or cancel orders

We may refuse or cancel an order, including because of a pricing error, a technical error, or suspected fraud or an unauthorized transaction.

8. Acceptable use and fair play

You may use the Service only for lawful purposes and in line with these Terms. You agree not to:

• Use bots, scripts, scrapers, automated tools or unauthorized third-party software to access or play the Service, or to collect its questions, answers or data
• Exploit bugs or vulnerabilities, or otherwise cheat to gain an unfair advantage, including by tampering with scores, streaks or the game's requests
• Create accounts or sessions to get around limits, bans or the one-score-per-day rule
• Attempt to gain unauthorized access to the Service, our servers, our database or any connected system, or interfere with or disrupt them, including with denial-of-service attacks
• Introduce viruses or other harmful code
• Impersonate another person or misrepresent who you are
• Use the Service to harass or abuse others, including through your display name
• Copy, sell or resell the Service or its content, or use it for a commercial purpose, without our written permission
• Reverse engineer or attempt to extract the source code of the Service, except where law allows

If you become aware of any violations, please report them to us immediately by contacting support@lastlaptrivia.com.

9. Scores, streaks, leaderboards and game integrity

All decisions about gameplay, scoring, streaks, leaderboards, moderation and enforcement of these Terms are made at our discretion and are final, except where the law says otherwise. We may remove, adjust or invalidate scores, and reset streaks, that we reasonably believe were obtained through cheating, exploitation or technical manipulation, or that result from an error. We may also correct puzzles or answers and recalculate results.

We try to keep and recover your progress, but we cannot guarantee it. Progress stored in your browser may be lost if you clear your browser data, and we may be unable to restore it.

10. Trivia content and map accuracy

We prepare our trivia content in good faith, but we do not guarantee that every question, answer, date, location or map position is complete or accurate. Pins are scored by their distance from the answer we have set. Satellite imagery is supplied by Esri/ArcGIS and may be out of date or imprecise. Nothing on the Site is professional advice of any kind.

11. Intellectual property

The Service and its original content, including the questions, puzzle design, scoring system, text, graphics, software and the Last Lap Trivia name and branding, belong to us or our licensors and are protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. You may not use our name, logo or branding without our prior written consent.

Third-party names and marks

Names, logos and marks of racing series, teams, drivers, circuits, sponsors and other third parties that appear in the trivia belong to their respective owners and are used only to identify the subjects of the questions. Last Lap Trivia is an independent game and is not affiliated with, endorsed by or sponsored by them, unless we expressly say otherwise, such as in a sponsorship notice. Map imagery and ads are provided by third parties and remain their property.

12. Feedback

You may send us feedback, suggestions, ideas or error reports, by emailing us at support@lastlaptrivia.com. You agree that we may use your feedback freely, for any purpose and without payment or credit to you, and that we have no obligation to keep it confidential.

13. Copyright complaints

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights ("Infringement") of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to support@lastlaptrivia.com with the subject line "Copyright Infringement" and include: a description of the work you believe was infringed; where on the Site the material appears; your name, address, phone number and email; a statement that you have a good faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We may remove material and take other action in response.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

14. Third-party services and links

The Service relies on and may link to services we do not own or control, including Google, Supabase, Vercel, Stripe, Esri/ArcGIS, Resend, third-party advertisers and sponsors. We are not responsible for their content, availability, terms or privacy practices, and we strongly advise you to review the policies of every site you visit. Your use of them is at your own risk.

15. Privacy

Our Privacy Policy explains what information we collect and how we use and share it, and forms part of these Terms. By using the Service, you acknowledge that you have read it.

16. Termination

You can stop using the Service at any time. You can delete your account from your account page or by emailing us at support@lastlaptrivia.com, as described in our Privacy Policy. Deleting your account does not by itself cancel a paid subscription. We recommend cancelling your subscription first, then deleting your account if you wish to do so.

We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms, abused the Service, or created risk or legal exposure for us or others, or if we discontinue the Service.

Provisions that by their nature should survive termination will survive, including those on intellectual property, disclaimers, limitation of liability and governing law.

17. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

18. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, SCORES, STREAKS, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

19. Indemnification

To the extent permitted by law, you agree to defend and hold us harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Service.

20. Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict of law rules. If you have a dispute with us, please contact us first at support@lastlaptrivia.com so we can try to resolve it informally. If we cannot, the state and federal courts located in Florida will have exclusive jurisdiction, and you consent to the jurisdiction of those courts. This section does not take away any mandatory consumer protection rights you have under the law of the place where you live.

21. Changes to the Service

We may change, suspend or discontinue any part of the Service at any time, including features, the free version, or the paid subscription. We will not be liable if all or part of the Service is unavailable at any time. If we make a change that materially reduces what a paid subscription includes, we will tell you in advance where practical.

22. Changes to these Terms

We may update these Terms from time to time. We will post the new Terms on this page with a new "Last updated" date, and will give additional notice, such as by email or a notice on the Site, for material changes. Changes take effect when posted, or on the date stated in the notice. If you keep using the Service after changes take effect, you accept the revised Terms. If you do not agree, you should stop using the Service and may cancel any subscription.

23. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Service and replace any earlier agreements. If a court finds any part of these Terms unenforceable, the rest will remain in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent. We may transfer ours, including in connection with a sale or transfer of the Site.
